TRAP Trademarks and Rights Holders Against Piracy

Trade Mark and Rights Holders Against Piracy (T.R.A.P) was founded in 2003 as a non profit making organisation and was formed to protect the rights of member companies, particularly in relation to the illegal sale of counterfeit product. The organisation has initially been formed for the protection of the music merchandising industry, although interest in joining has been expressed by other merchandise sectors, including toy manufacturers, sports/leisure merchandisers and high street retailers. The founder members of TRAP are an alliance of the major music merchandise companies, responsible for approximately eighty-five percent of the legitimate merchandise business in the UK.

The organisation aims to identify infringing activities and the individual and/or companies behind such activities, obtain significant levels of evidence of those activities and then enforce criminal and civil remedies against them using trade marks, design right, copyright and trade description legislation. The merchandising profession held an industry wide seminar in November 2002 at which the problems were identified, loss/damage quantified and legal solutions provided as to how an effective and coordinated approach could be taken to the infringement problem. The solution was to form a rights body to act as a representative trade association on behalf of the business. Accordingly, TRAP was formed.

TRAP works closely in partnership with enforcement agencies, authorities, trade associations and other anti-counterfeit organisation on matters such as education, prevention and enforcement as well as seeking to provide information and education to concert venues, retail stores and the general public.

Q:        Why has my auction been removed?

A:        TRAP is committed to the enforcement of its members trademarks and other intellectual property rights.Your auction's removal is because TRAP has a good faith belief that the merchandise you were offering for sale is counterfeit and/or infringes our copyright / trademarks. 
           
Q:        How did TRAP determine that my auction offered goods for sale that were counterfeit or otherwise infringing?

A:        Due to the nature of eBay and the Internet, this determination was based upon the photograph(s), title of the auction and the description of the goods that you have provided.  If your auction was terminated upon our request, we are satisfied with our determination that this item is not authentic.

Q:        Why did eBay allow me to post my auction if it is against the law?

A:         eBay has told us that they cannot conduct a comprehensive pre-screen of their auctions.

Q:        Why did TRAP not contact us directly before requesting eBay to remove my auction(s)?

A:         Given the number of companies and artists we represent it is not time permitting for TRAP to contact each seller individually before instructing eBay to remove the auction.

Q:        What will happen if I re-list or list another infringing item?

A:          It will be removed again, and eBay may also suspend your account.

Q:         There are many other auctions on eBay similar to the one I was selling, why was I singled out?

A:          You were not singled out. TRAP monitors auctions posted on eBay daily and endeavours to remove all of the infringing listings. If you would like to report an infringing listing, please send us the item number to BAYWATCH@GIGS.UK.NET
