Our software contains an End User License Agreement (ULA and by receiving and or using the software, the end-user agrees to the terms and conditions of the EULA. The EULA specifically excludes the rights to redistribute our products. Our software must be purchased through our company or through a licensed reseller to be properly licensed and available for use royalty-free.Illegal distribution of software can subject a seller to arrest and felony charges with fines up to $250,000 and prison terms of up to 5 years. In civil litigation against infringers trafficking in SmartSound products that are illegally distributed or reproduced, SmartSound can obtain the higher of its lost profits, the infringer profits, or statutory damages of up to $100,000 per product, per infringement, in addition to recovery of SmartSound attorneysfees in the action. Apart from legal consequences, using pirated copies of the Software also means greater exposure to viruses; corrupt disks, or otherwise defective software; and invalid serial numbers; lack of technical product support available to properly licensed users; and ineligibility for software upgrades offered to properly licensed users.
