Onkyo USA Corporation

About Onkyo USA Corporation

ONKYO is an organization consisting of people unsurpassed in the love of sound. We love our work, and that makes us perfectionists. We won't settle for second best. We strive to complete what we have started. That's the ONKYO spirit. For the past half century ONKYO components have been recognized as uncommonly musical among those who are truly fanatical about their music. Our aim for the next century is further refinement of our advanced music reproduction technology in order to create a new ONKYO that will become a more familiar name to people throughout the world.

Because Onkyo is committed to providing consumers with high quality, reliable products, we sell our products through a network of authorized dealers. We train Onkyo Authorized Dealers to properly demonstrate, give guidance on proper installation and provide after-sale support for our products. All Authorized Internet Dealers display the Onkyo Authorized Internet Dealer logo on their Websites.

To ensure that you receive the quality products and service that you are entitled to when you purchase Onkyo products, it is important that all your purchases of Onkyo products be made only from Onkyo or an Onkyo authorized dealer. Only products purchased directly from Onkyo or an Onkyo authorized dealer will be covered by Onkyo's warranty!

A number of retailers that sell our products are not Onkyo Authorized Dealers. An unauthorized dealer may offer our products for sale via direct retail sales, mail order or the Internet. The products they sell may be acquired through illegal methods or questionable business practices. The goods may be damaged, defective, used or even counterfeit. Serial numbers may have been removed. Products may not come with proper warranty information, boxes may not include all original contents as packaged by Onkyo, or the goods may not have been designed for use in the U.S. These goods may not be able to be exchanged or returned if there is a problem. These unauthorized dealers can not offer full warranty support and service.

IF YOU PURCHASE AN ONKYO PRODUCT FROM AN UNAUTHORIZED DEALER, YOUR ONKYO WARRANTY WILL NOT BE VALID, so check your source or contact us - we'll gladly direct you to an Onkyo Authorized Dealer! For more information on Onkyo warranties, please see onkyousa.com

Any dealer selling on Ebay violates Onkyo's dealer agreement. Onkyo does not authorize its dealers to sell new Onkyo products via on-line third party sites such as eBay. Therefore, it is false and misleading for an auction seller to claim to have "New" Onkyo brand products for sale because the seller is not authorized by Onkyo to sell the product on such sites and because it falsely suggests that the purchaser will receive the full array of Onkyo quality and customer service (such as manufacturer's limited warranty) that consumers can expect from an authorized dealer. Thus the foregoing claims use of the Onkyo trademarks in a manner calculated to deceive consumers, and is strictly prohibited. Onkyo makes every effort to protect its trademarks, corporate logotype, label designs and various products names and ensure that others do not misuse them. Onkyo will not allow use of its trade name (company name), trademarks (brand names), designs or symbols by any person without its prior permission being granted by Onkyo. In addition, Onkyo is the owner of the copyrights in all pictures, text and graphics on the Onkyo website, the Onkyo SoundCatalogue and all other Onkyo publications. Onkyo is aware that unauthorized sellers often promote the sale of Onkyo products by unlawfully copying some or all of these protected materials. Again, such copying is strictly prohibited by federal law, and will not be tolerated by Onkyo. If you have any concern about whether a particular seller is authorized by Onkyo you can get answers at Onkyo's website, http://www.onkyousa.com.

Also, by United Sates Law, any business or person acting as a business cannot sell an item without stating the policies/regulations that apply with that item. For example, if you sell a Onkyo product as new, that item must state it does not carry a warranty from the manufacturer of that item, or the transaction is considered illegal, due to false advertising. Onkyo does not warranty any items sold by unauthorized dealers, therefore those policies must be stated on a item that is being sold so that a customer is not falsely lead to believe they will have a valid warrant from Onkyo when they need to return it for warranty.

Frequently Asked Questions (FAQ)

Q: Why was my auction ended?

A: If you received an email about your auction, or your auction was removed by the Ebay VeRO (Verified Rights Owners) program, your auction was Infringing on Onkyo USA Corporation's copyright, trademark, warranty or other rights. Most commonly, auctions are ended for one of the following reasons:

  1. Item illegally uses copyrighted material or a trademark owned by Onkyo Corporation.
  2. Item stated or implied that the product was covered under warranty. Warranties are not transferable and ARE NOT VALID ON ANY ITEM SOLD ON EBAY.
  3. Item uses the name Onkyo but is not an authentic Onkyo product.
  4. Item is illegally being sold on Ebay using false advertising. (Item is offered as new and for sale by a seller that is not an authorized Onkyo dealer; and/or does not clearly state that the item does not carry the manufacturer warranty.

Q: I am an individual that wants to sell my used Onkyo product. Can I sell my item on Ebay?

A: Yes, Onkyo does allow auctions of any personal, used products as long as seller does not violate any copyright or trademark infringements. Under no circumstances can any copyright or trademark belonging to Onkyo USA Corporation be used without written permission. Also, to prevent your item from inadvertently being ended, please

  1. USE YOUR OWN PICTURES & TEXT,
  2. CLEARLY STATE THAT THE ITEM IS USED,
  3. CLEARLY STATE THAT THE SELLER IS IN NO WAY AFFILIATED WITH ONKYO, and
  4. CLEARLY STATE THAT THE ITEM DOES NOT CARRY THE MANUFACTURER'S WARRANTY.

Q: I took my pictures and/or text from a website other than Onkyo's site; Why did eBay say I violated Onkyo's copyright or trademark?

A: Copying pictures or text from any website is against copyright laws. Many websites are authorized dealers and have written permission to use Onkyo's trademarks and copyrighted material. Any unauthorized use of Onkyo's trademarked logo is against the law. Please be sure to use your own pictures and text when listing an item.

Q: Why did eBay allow me to post my auction if it is against the law?

A: Despite repeated requests, eBay has said that they cannot conduct a comprehensive pre-screen of their auctions. Therefore, certain impermissible items are allowed to be listed thereby causing both time and money to be wasted by the buyer, the seller and Onkyo.

Q: Why does Onkyo care if I sell a single piece of unauthorized Onkyo merchandise?

A: Onkyo has expended considerable resources to develop and maintain a reputation for providing the highest quality products and services to its customers. Through the auction of unauthorized merchandise, people attempt to trade off of Onkyo well-earned reputation. These auctions not only cause monetary damage, but also damage Onkyo's reputation, as many of the purchasers of inferior unauthorized products will attribute the poor quality merchandise to Onkyo.

Having spent many years cultivating its strong reputation, Onkyo must take action to ensure that online auctions of unauthorized goods are ended, even by single-item sellers.

Q: Why can't I use the word "Onkyo" in my auction heading even though I am not selling a Onkyo item?

A: It is misleading and impermissible to use the word "Onkyo" when there is no legitimate connection between the goods sold and the use of the name.

Q: Why can't I describe my item as "Onkyo-STYLE", "Onkyo-LIKE" or a similar phrase?

A: Due to Onkyo's fame, a person who sees the "Onkyo" name is likely to believe that the goods are in some manner connected with or endorsed by Onkyo, to Onkyo detriment and contrary to both state and federal law.

Q: Where can I find more information about prohibited, questionable, and infringing items on Ebay?

A: Ebay has a full set of pages to help you determine if what you are selling is legal in the eyes of the law. See the following Ebay help pages under Is My Item Allowed?:

Onkyo reserves the right to ask Ebay to cancel auctions for additional violations not listed above.
