Buying and Selling MakeMusic! Inc. Software
Resellers, if you have an agreement with MakeMusic! Inc., and are a legitimate distributor of MakeMusic! Inc. software on eBay, it is your responsibility to ensure that the software is genuine and is being distributed consistently with all applicable licenses.

Purchasers should be aware that MakeMusic! Inc. software available over the Internet may be counterfeit or otherwise unauthorized. Consumers who purchase such software have no right to use or redistribute the software that they receive, and will have no access to technical support or product upgrades. The end-user license agreement for all MakeMusic! notation products, including Finale, states that the purchaser may not transfer, assign, sell, or otherwise dispose of the software on a permanent basis without the written permission of MakeMusic! Inc. Finale software and accompanying documentation materials are protected under federal copyright and patent laws. Unauthorized copying or use of the software beyond the scope of the license agreement is expressly forbidden. The purchaser is provided the opportunity to review these terms and conditions during the installation process, in the manual and/or on our website.

Section 106 of U.S. Copyright law gives MakeMusic! Inc. the exclusive rights to reproduce its copyrighted works in copies, and to distribute the copies to the public. Copyright laws of the United States of America (See 17 U.S.C. Sec. 501 et. seq.) prohibit unauthorized reproduction of software. These laws include severe monetary penalties for violators in the form of actual or statutory damages as high as $150,000 per work infringed, as set forth in Section 504(c)(2). In addition, the Copyright Act provides for impoundment and destruction of all copies made or used in violation of the copyright owner's exclusive rights. 17 U.S.C. 503. If forced to pursue litigation, we will seek the maximum damages available, which may be $150,000 per work, and also seizure of the infringing articles and subsequent destruction. MakeMusic! Inc. vigorously enforces its intellectual property rights. To protect consumers and to safeguard our intellectual property rights, MakeMusic! Inc. monitors the Internet to identify auctions or other sales of unauthorized software. It is possible that some infringing auctions escape MakeMusic! attention. The fact that others may be selling products that infringe MakeMusic! intellectual property rights does not give anyone else the right to do so nor does it prevent MakeMusic! Inc. from ending those auctions of which it does become aware.
