Software Piracy
Many businesses and organizations, both in the United States, and abroad, do not know that they may be using illegal software. Network Associates, the company that helps organizations watch over their network, wants to provide you the information necessary to ensure you lawfully use our products thereby getting maximum value from them.
Software piracy is a big business. Figures supplied by the Business Software Alliance show the industry loses nearly US$36 billion annually from software piracy worldwide. Translated into percentage figures, 35%, or more than one in every three applications used in business is used illegally.
McAfee, Inc. is committed to educating its authorized users and when necessary, bringing those violating our licenses into compliance.
While there are many types of software piracy, all forms hurt both the user and McAfee. McAfee is deprived of the revenue for creating and supporting the program, while the purchaser may be harmed by receiving incomplete and/or software modified by the introduction of a virus.
McAfee licenses are non-transferable. The terms of use of the software are included with every authorized package that McAfee distributes, either directly or through its resellers.
McAfee regularly reviews auctions and works with eBay in removing auctions based on one or more of the following reasons:
The software was duplicated or distributed in violation of the end-user license agreement (including OEM software) and McAfee intellectual property rights;
The software being offered had previously been used to obtain an upgrade to a newer version and transfer from the prior owner is prohibited;
The software box was modified/opened to remove the UPC code;
The software was labeled to a specific type of user (e.g. academic, NFR, Media Kit etc.) in violation of applicable agreements with McAfee and further distribution by sellers constitutes patent, trademark and copyright infringement;
Are distributed on "back-up" disks, or are otherwise incomplete;
McAfee does not recognize, or support the transfer of any McAfee hardware (appliances) that occur without a valid McAfee transfer of ownership document signed by both parties. Buyers of such product are cautioned that hardware warranty restrictions may exist.
Illegal distribution of software can subject a seller to arrest and felony charges with fines of up to US$250,000 and prison terms of up to five years. In civil litigation, McAfee can obtain the higher of its lost profits, the infringers profits, or statutory damages of up to US$150,000 per product, in addition to recovery of McAfee attorney's fees in the action.
