Q: Why was my auction ended?
A: You may have received an email directly from Jemella Ltd about your auction, or your auction may have been ended through the Ebay VeRO (Verified Rights Owners) programme. If this is the case, your auction has been deemed to be infringing on Jemella Ltd’s copyright, trademark, warranty or other rights. Because of the way eBay works, we can only make this determination based upon your auction’s title, description or photographs.
Q: Why can’t I use the word ‘ghd’ in my auction description even though I’m not selling a ghd product?
A: When not selling a ghd product, use of the word ‘ghd’ is misleading as there is no legitimate connection between ghd and the products being sold.
Q: I want to sell my used ghd products. Can I do this on Ebay?
A: ghd will not attempt to prevent the sale of personal, used products through Ebay. Such advertisements must not violate any copyright or trademark descriptions belonging to Jemella Ltd. Use of such imagery or text can only be used with express permission from the rights owner.
Q: Why did Ebay allow me to post my listing if it is against the law?
A: Due to the volume of listings received daily, Ebay are unable to screen and filter all illegal listings. It is the responsibility of the rights owner to facilitate the removal of illegal listings from Ebay.
Q: Why has Jemella Ltd removed the only item I am listing even if it is un-authorised?
A: Jemella Ltd have invested millions of pounds into developing the ghd brand. In order to ensure that our customers continue to benefit from the highest quality products and service, we have developed a rigorous policy of enforcing our Intellectual Property Rights, both through the Courts and by cooperating fully with the Police and Trading Standards.
Q: Why cant I say my item is ‘LIKE ghd’ or something similar?
A: Due to the global brand presence that ghd carries, consumers may well associate Jemella Ltd with other goods and assume that the goods are endorsed by ghd.
Q: I think the item I offered is genuine. How can I tell if it is real?
A: We cannot provide consumers with detailed information on how to determine genuine ghd products. The best way to be certain that the product you are buying is genuine is to purchase through an ‘Approved’ ghd stockist or direct from www.ghdhair.com
If you feel that your listing has been removed unfairly, please send through copies of your advert to vero@ghdhair.com where we will be able to make a more detailed analysis of your advert. In the event of agreement from ourselves that your item was unfairly removed, we will contact Ebay on your behalf and ask for your item to be re-listed.
