Audible, Inc. is the world leading provider of digital audio spoken word products and services, and has been selling spoken word products and subscription services for its spoken word products and services since 1997. Audible has a well-established reputation in the United States and worldwide for its products and services.
Audible catalogue of copyrighted spoken word products includes thousands of audio titles, including audiobooks, audio editions of magazines and newspapers, radio programs and original programs that won't be found in this form anywhere else. Audible converts audiobooks and other spoken audio programs into digital files that can be downloaded over the internet and enjoyed in a variety of ways by users purchasing licenses from Audible. Audible makes its content available on a licensed basis.
Audible takes very seriously its legal obligations to protect and enforce its and its licensorscopyrights, trademarks and other intellectual property rights. Audible began enforcing rights on eBay upon becoming aware that Audible content and programming was being offered for sale without authorization and in violation of Audible license agreement. Audible name and trademarks also have been used in connection with these sales again without permission from Audible. By working to stop unauthorized sales and use of its and its licensorsintellectual property, Audible hopes to protect its good name and reputation for high quality, and to protect consumers from being deceived into believing that they are receiving legally made copies of Audible and its licensorscopyrighted content.
Unfortunately, due to the nature of eBay, it is impossible to prevent unlawful transactions in advance. The fact that an offering is made on eBay does not mean that it is authorized or legal. Therefore, before purchasing content purporting to be from Audible or if you see sellers using the Audible name or any Audible trademarks, we urge you to contact Audible:
(1) to determine the authenticity of the materials being sold, and
(2) to determine if the sale, distribution, or other use of Audible content or the Audible name or trademarks has been authorized by Audible.
Even small sales or transactions can have serious consequences. Selling, distributing or otherwise offering materials owned by Audible or using Audible name, without Audible permission, violates the Audible license agreement and infringes upon Audible and its licensorsintellectual property rights. In addition, the unauthorized sale, distribution or offering of these materials violates state, federal and international laws and treaties. Audible uses digital rights management (DRM) technologies to protect its licensed content from unauthorized use. Disabling or circumventing Audible DRM technologies violates the federal Digital Millenium Copyright Act. Buyers assume the risk on materials they purchase through eBay.
