Terms and Conditions of Sale.
The Buyer accepts and agrees these terms and conditions on purchasing from the Seller.
The Seller offers a seven day cancellation policy on Buy It Now Item Listings or Second Chance Offers purchased with a UK delivery and purchase address. Buy It Now Item(s) or Second Chance Offers must be cancelled in writing within seven days after the day of receipt, using either the Ebay message service, or in writing by recorded delivery to the Seller’s address Midas Building, Swanston’s Road, Great Yarmouth, Norfolk NR30 3NQ together with the Ebay date of invoice, the Ebay Item Number, the Ebay Buyer User ID and the reason for cancellation. Buy Now item(s) and Second Chance Offers the subject of cancellation, must be returned within 14 days after the day of receipt at the Buyer’s expense and risk (it is suggested that the Buyer return the item(s) by either Royal Mail recorded delivery or some other method, whereby the Buyer obtains a signature as proof of delivery, the item(s) being returned shall be at the Buyer’s risk for damage or loss until safely received by the Seller). Item(s) returned must be unworn, unused and in their original new condition, complete with the original packaging (please try on footwear on a carpet). If returned item(s) have been worn, used or are not in their original new condition and complete with original packaging these will be returned to the Buyer at the Buyer’s expense. If the Buy It Now Item Listings or Second Chance Offers item(s) is returned by the Buyer and received by the Seller not within the agreed 14 days after the day of receipt by the Buyer, then the Seller reserves the right to deduct a restocking charge of 20%, or £5.00, whichever is the greater of the Seller’s invoice value for the item(s), to be deducted from the refund amount. There are exclusions to this cancellation policy please see below. Refunds will be less the cost of post and packing, all postage and packing costs incurred are the responsibility of the buyer. To resend undelivered item(s) that have been returned, or exchange item(s) will incur additional postage or courier cost at the Buyer’s expense. Item(s) are inspected and checked by the Seller prior to dispatch, however in the event of the item(s) being faulty when received, the Seller will offer either a refund, exchange the item(s), or if the Buyer has damaged the item(s) the Seller will return the item(s) to the Buyer, item(s) damaged by the Buyer being unreasonable whilst trying on or using an item is not the Seller’s responsibility (please buy the correct size boot fitting, the Seller offers wide leg and calf sizes, the Seller does not take back boots that have had the zip forced and broken by the Buyer trying to fit a wide leg into a standard boot). The Seller shall claim against the Buyer right of action for breach of statutory duty, if the Buyer does not take reasonable care of the item(s) whilst in the Buyer’s possession and during the return of the item(s) to the Seller, if the Buyer fails to return the item(s), then the Seller reserves the right at the Buyer’s expense, to appoint an outside collection agency to collect either the item(s), or the value thereof, the Buyer shall also bear the full costs incurred in writing letters, telephone calls, or visits to the Buyer to recover the item(s) or value thereof, the costs of which will accrue for payment by the Buyer. Please contact the Seller using the Ebay message service for a refund, exchange or faulty item, the Seller will email a return number and information on where to return the item with Buyer information required. This policy excludes latex rubber, pvc and nylon items, for the reasons of health and safety, hygiene and the physical impossibility of restoring these items to a new condition by the Seller, the Seller does not refund or offer exchange on these items. This does not affect your statutory rights. Items won in Auction format listings are excluded from this cancellation policy and are non-returnable. All items for sale or auction are listed on Ebay as novelties only. Insurance for loss or damage in transit is available for all item(s) listed, the Buyer can either buy insurance on the ebay listing or request insurance from the Seller, if no insurance has been taken out then the items posted are at the Buyer’s risk and the Seller accepts no responsibility for lost, damaged or non received item(s). In no circumstances shall the Seller be liable to the Buyer or any third party for any indirect or consequential damage or loss howsoever arising. The Seller’s aggregate liability to the Buyer or any third party (whether for negligence or otherwise) shall not exceed the Seller’s Ebay invoice price of the item or items in respect of which liability arose in relation to any occurrence or series of occurrences. This agreement sets out the entire agreement and understanding between the Buyer and Seller and shall for all purposes be treated as having been made and completed at the Seller’s Address as above and as operating as a separate and distinct agreement in relation to each item specified, independently of any other such agreement. No representation, term or condition not set out in these Terms and Conditions of Sale or alteration or variation of the terms hereof shall bind the Seller accept where made in writing and signed by a Director of the Seller. This Agreement shall be governed by the Law. Both the Buyer and the Seller hereby submit to the jurisdiction of the English Courts. All rights reserved. No part of this publication may be reproduced or transmitted in any form or by means – electronic, photocopying, recording or otherwise or stored in any retrieval system of any nature without the written permission of the copyright holder and the publisher, application for which shall be made to the Seller.
