Arai Helmet Americas is the North and Latin American representitive for Arai motorcycle helmets. To protect our customers, dealers and distributors, Arai monitors eBay and the Internet for violations of Arai's trademarks and for sales that do not comply with Arai's distribution policies and programs.
Auctions on eBay and the Internet must comply with the following:
NO USE OF ARAI'S PICTURES, TEXT AND GRAPHICS:
These materials, from Arai's websites or published sources, are not in the public domain and the law prohibits copying them for any auction or Internet sale.
NO SALES BY ANY AUTHORIZED DEALER OF ARAI HELMETS:
Arai's policy is that its dealers may not sell its helmets over the Internet or by eBay auction. This is done to assure that dealers properly fit customers for helmets in the dealers' showrooms.
Arai has elected not to deal with any dealers who attempt to sell Arai helmets over the Internet, including selling by eBay auction, and will terminate any authorized dealership for these types of sales. Any violation could subject the dealer to penalties for trademark infringement, breach of contract or other legal action.
NO SALES BY ANY DEALER WHO IS NOT AN AUTHORIZED DEALER OF ARAI HELMETS:
Customers should always seek the store of an authorized Arai dealer who is trained to assist in the proper selection and fit of Arai's helmets.
SALES BY INDIVIDUALS OF PERSONAL HELMETS MAY NOT MISLEAD BIDDERS:
An individual person may choose to resell his/her Arai helmet as long as the sale is not misleading by indicating, for example, sale by a dealer or referring to Arai for a helmet other than the Arai brand.
Failure to comply with the above can violate eBay's user agreement and may result in withdrawal of an auction and permanent suspension from eBay. Please review eBay's copyright and trademark guidlines for further information.
